Abstract
This article examines the challenges posed by algorithmic governance to the rule of law. As governments and legal institutions increasingly rely on algorithms and automated systems to make decisions, questions arise about whether these systems can uphold the core values of the rule of law, including legality, legal certainty, equality before the law, accountability, and the protection of fundamental rights. The article analyzes the concept of algorithmic governance and its relationship to traditional rule of law principles, identifying areas of tension and conflict. It argues that algorithmic governance can be consistent with the rule of law, but only if appropriate safeguards are in place to ensure transparency, accountability, fairness, and human oversight. The article proposes a framework for ensuring that algorithmic governance respects and upholds the rule of law, emphasizing the need for legal frameworks, institutional oversight, and human centered design. It concludes that the preservation of the rule of law in the digital age requires proactive and principled approaches to algorithmic governance.
